The Audiovisual Media Services Regulations 2014 were the UK statutory instrument that pulled paid online porn—video on demand and other streaming—under the same R18 rules that already governed sex-shop DVDs. Before 1 December 2014, neither Ofcom nor the British Board of Film Classification had jurisdiction over that paid streaming market. The Secretary of State made the regulations under section 2(2) of the European Communities Act 1972. For BDSM producers and viewers the point was blunt: a list of acts common in consensual kink—restraint that blocked a safeword, breath play, facesitting, fisting, watersports, SM past “trifling” pain—became illegal to depict on UK-based VOD. A 2019 review of obscenity law later legalized depiction of those acts if they were consensual, did not harm the participants, and were unlikely to be seen by anyone under 18.
What the 2014 Rules Actually Banned
British obscenity law already forbids publications that may seriously harm a performer or threaten their life. What the 2014 instrument added was parity: online paid porn would face the same cuts as material sold over the counter. Acts the BBFC already banned on home video—and that the regulations therefore restricted online—included sadomasochistic material that went beyond the “trifling or transient” infliction of pain or injury; physical restraint that prevented a participant from indicating withdrawal of consent; urolagnia; erotic asphyxiation; facesitting; and fisting.
The Department for Culture, Media and Sport defended the package by calling the BBFC’s R18 certificate a “tried and tested” way to protect children and by stressing consistency across formats. Peter Johnson, chair of the Authority for Television On Demand (ATVOD), argued that unregistered overseas material would still breach the Obscene Publications Act 1959 and that credit-card payments to premium sites could be blocked. The regulatory theory was simple: if a sex shop could not sell the disc, a UK VOD platform should not stream the file.
Facesitting in Parliament Square
The rules took effect on 1 December 2014 and drew immediate fire, much of it focused on female ejaculation. A Vice interview with BBFC officials indicated that apparent female ejaculation was regularly cut because of the urolagnia ban and the difficulty of telling squirting from urination. A New Statesman blog noted that many of the listed acts were popular in LGBT and BDSM communities or were expressions of female sexuality. Obscenity lawyer Myles Jackman warned that the regulations set a dangerous precedent and called pornography “the canary in the coal mine” of free speech.
Opponents protested in Parliament Square on 12 December 2014. Sex worker and Clacton by-election candidate Charlotte Rose organized the action: a mass facesitting demonstration and a sing-along of Monty Python’s “Sit on My Face.” One sign read, “Urine for a shock if you expect us to stop.” Rose and other women erotic performers objected that the regulations had been approved without a parliamentary vote or public consent, and that they could be a first step toward wider obscenity changes. Liberal Democrat MP Julian Huppert (Cambridge) tabled an Early Day Motion seeking a debate to annul the instrument. Fellow Lib Dems David Ward and John Leech signed, as did independent MP Mike Hancock. Huppert said any regulation of sex or porn should rest on consent and risk, not “moral objection.” Deputy Prime Minister and Lib Dem leader Nick Clegg backed the EDM, arguing that politicians should not sit in judgment on anyone’s sexual behaviour and that supporting sexual freedom was a “classic liberal assertion.”
Feminist and Femdom Critique: Whose Pleasure Got Cut
After the December protest, the feminist magazine Bitch attacked the regulations for censoring women’s sexuality. “The laws seem to specifically target acts that prioritize female pleasure or indicate female dominance,” the piece argued. It pointed to a double standard: men could take a dominant position in oral sex; women sitting on a face could not. Author Catherine Scott spelled out the asymmetry. Female ejaculation was banned; male ejaculation and its consumption stayed legal. The BBFC itself reported that the act it most regularly censored was “scenes of choking and gagging during deep throat fellatio”—and there was no move to ban those scenes, only the ones in which a woman received pleasure from sitting on a man’s face.
Pandora Blake, who ran the BDSM site Dreams of Spanking, said the sites shut down for non-compliance “have been gay sites and female domination. No BDSM sites with female submissives have been targeted because that [women’s subordination] is apparently fine.” For kink law that sentence is the heart of the 2014 fight: the state did not treat all SM as equal. Femdom, gay SM, facesitting, and female ejaculation were the easy cuts. Submissive women in conventional grovel scenes were not the enforcement priority.

How a Statutory Instrument Became Kink Law
The legal mechanics still matter for anyone who archives UK porn fights. This was not a statute the Commons debated line by line. It was a statutory instrument the Secretary of State made by using section 2(2) of the European Communities Act 1972—the same domestic power used to implement EU audiovisual rules—and it came into force on 1 December 2014. Ofcom and the BBFC, which had owned broadcast and disc classification, suddenly had a hook into paid streaming they had lacked. ATVOD’s Johnson talked about overseas sites, the 1959 Obscene Publications Act, and blocking credit-card rails to premium rooms. DCMS talked about children and about not letting a VOD file do what an R18 disc could not. Rose’s objection was procedural as much as sexual: no vote, no public consent, and a fear that obscenity law would keep moving once the instrument stuck.
Huppert’s Early Day Motion, the signatures of Ward, Leech, and Hancock, and Clegg’s line that sexual freedom was a “classic liberal assertion” are the parliamentary counter-record. They did not stop the instrument. They did name the standard kink people actually use: consent and risk, not a civil servant’s list of ugly positions. The 2019 revision matters as much as the 2014 ban. After an obscenity-law review, depiction of the listed acts became lawful again provided the sex was consensual, participants were not harmed, and the audience was not likely to include minors. That is closer to a kink-ethics test than to a moral inventory of positions. The four-year gap still did real damage: UK-based VOD pulled SM, breath play, and femdom content; some sites closed; and a generation of British producers learned that a statutory instrument issued under an EU-implementation power could rewrite what a legal dungeon scene looked like without a Commons vote.
